Dear Erli, zakat distribution provision has been explained in the Holy Qur’an: “Zakah expenditures are only for the poor and for the needy and for those employed to collect [zakah] and for bringing hearts together [for Islam] and for freeing captives [or slaves] and for those in debt and for the cause of Allah and for the [stranded] traveler – an obligation [imposed] by Allah. And Allah is Knowing and Wise.” (QS. At-Taubah : 60)
The ayat above is general; it does not explain specifically that if one member of our family is the needy so he/she is included as mustahik. In this case, there are several dissents among Islamic scholars. They doubt whether our brother or sister is included as those who we must bear. However, they strongly agree that zakat cannot be offered to our dependents such as son, daughter, wife, and parents.
Some of them such as As-Syaukani and Abu-Hanifah argue that we can give our zakat to our parents because there is not any law that forbids doing it.
Maliki and Syafi’i claim that we are allowed to offer our zakat to our brother or sister; if they are categorized as mustahik. Rosululloh S.A.W. said in the hadist that “giving zakat to the poor is shadaqah, while giving zakat to the poor relatives is shadaqah and silaturahim.” (HR. Ahmad)
